At LuaSOS, we believe technology can help identify a person faster, contact a family member in time, and ensure that in a moment of urgency or disorientation, the right information is available simply and securely.
These Terms and Conditions govern access to and use of our website, the purchase of LuaSOS products, device activation, use of the digital platform, and any services related to our bracelets, tags, plates, cards, or other products with QR, NFC, or equivalent technologies.
By accessing our website, purchasing a LuaSOS product, creating an account, activating a device, or using our services, you accept these Terms and Conditions. If you do not agree with them, you must refrain from using our products or services.
1. What is LuaSOS
LuaSOS is a physical and digital solution designed to facilitate identification and quick access to useful information when a person needs help, guidance, contact with family members, or assistance in emergency, loss, disorientation, or vulnerability situations.
Our services may include:
- physical devices with QR and/or NFC;
- a digital link or profile associated with the device;
- profile activation and management tools;
- uploading of contact information and other useful data for assistance;
- notifications to registered contacts;
- individual, family, institutional, or corporate management functions;
- additional services associated with specific plans or subscriptions.
2. Nature of the service
LuaSOS is a support and identification tool. It is not a medical service, does not replace ambulances, police, firefighters, health centers, emergency services, or public authorities. Nor does it constitute a permanent monitoring system, guaranteed geolocation, or immediate rescue service.
The actual functioning of the service depends, among other factors, on:
- the device being scanned or read by a third party;
- the third party's equipment being compatible with QR or NFC;
- the availability of internet access, battery, coverage, or technological availability;
- the registered information having been entered correctly and being up to date;
- the designated contacts being able to receive and respond to the alert.
Therefore, the user acknowledges that LuaSOS does not guarantee immediate intervention, third-party response, exact location, or any specific outcome.
3. Who can use LuaSOS
You may use LuaSOS if you have the legal capacity to enter into contracts under applicable law.
If the profile or device will be used by a:
- minor,
- elderly person,
- person with a disability,
- person with a relevant medical condition,
- person under the care, guardianship, legal representation, or assistance of a third party,
the purchase, activation, profile management, and acceptance of these terms must be carried out by their parent, guardian, legal representative, or duly authorized person.
Anyone who registers a profile on behalf of another person declares that they have sufficient authorization to do so and assumes responsibility for such action.
4. Purchase of LuaSOS products
The purchase of LuaSOS products is subject to stock availability, payment validation, logistics coverage, and order confirmation.
Prices may be displayed in Peruvian soles, US dollars, or other enabled currencies, depending on the country or sales channel. Taxes, shipping costs, customs charges, import fees, or other applicable charges will be disclosed before completing the purchase, when applicable.
LuaSOS may sell products within Peru and in other countries. For international purchases, the customer accepts that there may be regulatory, tax, logistics, or customs conditions specific to the destination country that could affect delivery times, final costs, or product entry requirements.
5. Device activation
Purchasing the product does not necessarily imply its automatic activation.
To use certain features, it may be necessary to:
- create an account;
- verify an email address or phone number;
- enter an activation code;
- link the device to a profile;
- complete a verification flow;
- select a plan, if applicable.
Each device may be associated with a serial number, identifier, token, unique URL, activation code, or other technical linking mechanism. This identifier is an essential part of the service's operation and must not be altered, manipulated, duplicated, or misused.
6. Account and security
When a feature requires a user account, the user is responsible for:
- maintaining the confidentiality of their credentials;
- providing truthful, accurate, and up-to-date information;
- periodically reviewing profile data;
- reporting any unauthorized use or security incident.
LuaSOS may suspend or block access when it detects unusual activity, suspected fraud, impersonation, security breaches, or violations of these terms.
7. Profile information
LuaSOS allows the owner or guardian to configure the information they wish to associate with the device. Depending on the enabled features, this information may include:
- name or reference name;
- photograph;
- emergency contacts;
- support notes or helpful instructions;
- optional medical information;
- allergies, medication, or relevant care details;
- language;
- relationship with guardian, family member, or institution;
- other data expressly enabled by the platform.
The user acknowledges and accepts that information marked as visible may be accessed by anyone who legitimately scans the QR, NFC, or associated link of the device.
Therefore, the user or guardian should only upload information they consider necessary, proportional, and appropriate for the intended purpose of assistance or identification.
8. Responsibility for uploaded information
The user, owner, guardian, or profile administrator is solely responsible for:
- the accuracy of the registered information;
- keeping the data up to date;
- the accuracy of the contacts;
- authorization to include third-party data;
- the level of information they choose to display publicly;
- the consequences arising from false, incomplete, outdated, or inappropriate information.
LuaSOS is not obligated to verify the accuracy of content uploaded by the user, although it may review, restrict, or remove content when it detects risk, illegality, or violation of these terms.
9. Sensitive data and consent
Some LuaSOS features may involve particularly sensitive data, such as health information, medical conditions, allergies, medication, disability, or other sensitive information.
The user declares that any personal or sensitive data incorporated into the profile has been provided with sufficient legitimate basis and, when applicable, with the valid consent of the data subject or their authorized representative.
LuaSOS may request additional acceptances, validations, or consents before enabling certain features, especially those related to sensitive data, minors, or automated communications.
10. Scanning, alerts, and notifications
When someone scans a QR code or uses the NFC functionality of the device, LuaSOS may, depending on the profile configuration and available features:
- display visible profile information;
- enable contact with family members or designated persons;
- generate technical records of the event;
- send alerts or notifications to contacts;
- share scan context information, including approximate location if technology and permissions allow.
Alerts may be sent via email, SMS, instant messaging, internal dashboard, or other channels integrated with third parties.
However, the user accepts that LuaSOS does not guarantee:
- immediate delivery;
- uninterrupted availability;
- effective reading of the message;
- response from contacts;
- absolute location accuracy;
- universal compatibility with all devices.
11. Permitted use
The user agrees to use LuaSOS diligently, responsibly, lawfully, and in good faith.
The following is prohibited:
- using LuaSOS for fraudulent, illegal, or deceptive purposes;
- registering profiles without authorization;
- impersonating individuals or institutions;
- entering false or harmful information;
- attempting to breach the system's security;
- copying, cloning, reselling, or improperly exploiting the platform;
- tampering with serial numbers, tokens, links, activation codes, or identifiers;
- performing scraping, reverse engineering, unauthorized testing, or attacks on the platform;
- using the service for purposes other than its reasonable purpose of identification and assistance.
LuaSOS may immediately suspend or cancel access to the service upon detecting any of these behaviors.
12. Loss, theft, or transfer of the device
In case of loss, theft, misplacement, assignment, or transfer of the device, the user must notify LuaSOS as soon as possible through the available channels.
LuaSOS may offer, depending on the contracted plan or service, options such as:
- temporary deactivation;
- suspension of the public profile;
- device reassignment;
- issuance of a new activation code;
- controlled transfer of administration.
Until the request is processed, the user acknowledges that the profile may continue to be accessible through the physical device.
13. Plans, subscriptions, and validity
LuaSOS may offer products or services under the following modalities:
- one-time purchase;
- temporary activation;
- monthly, annual, or other periodic subscriptions;
- family plans;
- institutional or corporate solutions;
- complementary or premium features.
The commercial terms of each plan, including duration, renewal, limits, benefits, and pricing, will be disclosed before purchase.
If a service requires renewal and it is not completed in a timely manner, some features may be suspended, limited, or become unavailable.
14. Returns, exchanges, and warranty
LuaSOS may have a specific policy for returns, exchanges, and warranty, which will complement these terms.
Unless otherwise required by mandatory law, the warranty will not cover damage caused by:
- improper use;
- impacts or incorrect handling;
- product alteration;
- normal wear and tear;
- exposure to conditions incompatible with the product's recommendations;
- loss or damage caused by third parties.
When applicable due to a manufacturing defect or error attributable to LuaSOS, we will evaluate the reasonable alternative of replacement, exchange, repair, or equivalent solution, in accordance with applicable law and current commercial policy.
15. Intellectual property
All rights to the platform, software, interfaces, design, content, documentation, databases, features, trademarks, logos, trade names, and other LuaSOS elements belong to LuaSOS or its licensors.
The purchase or use of the service does not transfer any intellectual property rights to the user, except for a limited, revocable, non-exclusive, and non-transferable authorization to use the service in accordance with these terms.
16. Integrations and third-party services
LuaSOS may operate or integrate with third-party services, such as payment processors, logistics operators, messaging providers, email tools, maps, hosting, analytics services, authentication, or cloud infrastructure.
The user accepts that part of the service's operation depends on these third parties and that LuaSOS is not responsible for interruptions, unavailability, blocks, errors, or decisions exclusively attributable to those external providers.
17. Privacy and personal data protection
The collection and processing of personal data by LuaSOS is further governed by our Privacy Policy, which forms a complementary part of these terms.
By creating an account, activating a device, uploading information, or using the platform, the user declares having read and understood said policy.
LuaSOS may process personal data necessary to operate the service, improve security, respond to requests, send account-related communications, or fulfill legal and contractual obligations.
When the operation of the service requires it, LuaSOS may use technological infrastructure or providers located inside or outside Peru, applying reasonable security, confidentiality, and compliance measures in accordance with applicable regulations.
18. Service availability
LuaSOS strives to offer a stable, reliable, and secure service. However, it does not guarantee uninterrupted availability, error-free operation, or total immunity to technical incidents, cyberattacks, maintenance, connectivity failures, or causes beyond its reasonable control.
LuaSOS may perform updates, improvements, preventive or corrective maintenance, and technical changes it deems necessary for the continuity, evolution, or security of the service.
19. Limitation of liability
To the maximum extent permitted by applicable law, LuaSOS shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, loss of opportunity, loss of data, or damages arising from:
- the use or inability to use the service;
- scanning not performed or failed reading;
- errors in information uploaded by the user;
- lack of response from contacts;
- technical interruptions;
- unavailability of integrated third parties;
- acts or omissions of persons who scan the device;
- actions by authorities, emergency services, or third parties unrelated to LuaSOS;
- force majeure events or acts of God.
Nothing in these terms excludes rights that consumer protection legislation recognizes as non-waivable for the user.
20. Suspension or termination of the service
LuaSOS may suspend, restrict, or terminate access to the service in whole or in part when:
- there is a breach of these terms;
- misuse or fraud is detected;
- there is a risk to the security of the system or third parties;
- required by a competent authority;
- the contracted plan's validity expires;
- the user requests service cancellation.
Termination shall not affect pending obligations or those provisions that, by their nature, must survive after the relationship ends.
21. Modifications to these terms
LuaSOS may update these Terms and Conditions to reflect legal, regulatory, operational, commercial, or technological changes.
The current version will be published on our website with its respective update date. When changes are significant, LuaSOS may communicate them via email, within the platform, or through other reasonable means.
Continued use of the service after the publication of changes will imply acceptance of the current version.
22. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Peru, without prejudice to the application of mandatory consumer protection or data protection regulations that may apply in other countries when legally required.
Any dispute related to the purchase or use of LuaSOS products or services shall be submitted to the jurisdiction of the competent courts of Lima, Peru, unless otherwise required by mandatory law.
